Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY. This notice is provided by Proveta Medical Group, P.C. (the "Medical Group"), the covered entity providing medical care through the Proveta platform.

Our commitment

We are required by the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and its implementing regulations to maintain the privacy of your protected health information ("PHI"), to provide you with this notice of our legal duties and privacy practices, to notify you following a breach of unsecured PHI, and to abide by the terms of the notice currently in effect.

Uses and disclosures for treatment, payment, and operations

Treatment

We use and disclose your PHI to provide, coordinate, and manage your medical care, including consultations with providers, pharmacy fulfillment of prescriptions, laboratory processing, and follow-up communications.

Payment

We use and disclose your PHI to bill for our services and to process payments, including verifying coverage where applicable.

Healthcare operations

We use and disclose your PHI for activities necessary to run our practice, including quality assessment, credentialing, auditing, compliance, training, and business planning.

Other uses and disclosures permitted or required by law

  • When required by law (including reporting of communicable diseases or suspected abuse).
  • For public-health activities authorized by law.
  • To health oversight agencies for audits, investigations, and inspections.
  • In response to a court order, subpoena, or discovery request in compliance with applicable law.
  • To law enforcement in limited circumstances authorized by law.
  • To coroners, medical examiners, and funeral directors.
  • For organ, eye, or tissue donation (if applicable).
  • For research purposes under approved protocols with appropriate safeguards.
  • To avert a serious threat to health or safety.
  • For specialized government functions (military, national security, or protective services).
  • As authorized by and to the extent necessary to comply with state workers' compensation laws.

Uses and disclosures that require your written authorization

  • Marketing communications (other than face-to-face communications and promotional gifts of nominal value).
  • Sale of PHI.
  • Most uses and disclosures of psychotherapy notes.
  • Any other use or disclosure not described in this notice.

You may revoke a written authorization at any time by notifying us in writing, except to the extent we have already relied on it.

Your rights regarding your PHI

  • Right to inspect and copy your PHI (we may charge a reasonable fee for copies).
  • Right to request an amendment if you believe information in your record is incorrect or incomplete.
  • Right to an accounting of certain disclosures we have made of your PHI.
  • Right to request restrictions on certain uses and disclosures. We are not required to agree, except in certain limited circumstances.
  • Right to request confidential communications by alternative means or at alternative locations.
  • Right to receive a paper copy of this notice, even if you have agreed to receive it electronically.
  • Right to be notified following a breach of unsecured PHI.
  • Right to file a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights. You will not be retaliated against for filing a complaint.

How to exercise your rights

Complaints

If you believe your privacy rights have been violated, you may file a complaint with us or with the Office for Civil Rights of the U.S. Department of Health and Human Services. Complaints to HHS may be submitted at https://www.hhs.gov/ocr/privacy/hipaa/complaints/. We will not retaliate against you for filing a complaint.

Changes to this notice

We reserve the right to change this notice. Any revised notice will apply to all information we maintain, including information created or received before the revision date. We will post the current notice on our website.
